Read this agreement thoroughly and carefully before booking a trip with us.
The terms and conditions set forth in this agreement constitute the entire understanding and agreement between you the trip “Participant” and 10Adventures Tours Inc “10Adventures Tours” with respect to any and all bookings, tours or transactions made with 10Adventures Tours.
By submitting a booking form and digitally agreeing to this agreement, you accept all of the terms in this agreement and direct us to perform services on your behalf. All persons named in this booking (“Participants”) are subject to this agreement. By signing this agreement, you affirm that you have made all other Participants listed in the booking aware of these terms – regardless of how final payment is made – and that all Participants accept these terms.
You may reserve space on a tour by booking on 10Adventures.com, 10a-tours.com or via phone. A booking is not final until you receive a final confirmation from us.
You should not book additional travel (such as flights) until you receive a confirmation notice that your booking has been accepted.
3. Deposits and Final Payment
A deposit of 30% of total tour cost is required at the time of booking. Final payment is due 45 days prior to departure. If your booking is made within 45 days of departure, the entire tour cost must be paid when we confirm the trip with you.
Payments may be made by credit card or bank transfer. If you pay your deposit by wire or check, we cannot confirm your reservation until your payment has cleared the bank.
4. Your details
In order for us to confirm your travel arrangements, you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips, we also require you to complete and forward a Self-Assessment form. Failure to provide requested details may result in additional charges or non-refundable cancellation of your trip.
The land price of your trip includes:
- All accommodation as listed in the Trip Information
- All transport listed in the Trip Information
- Sightseeing and meals as listed in the Trip Information
- The services of a group leader as described in the Trip Information
The land price of your trip does not include:
- International or internal flights unless specified
- Airport transfers, taxes and excess baggage charges unless specified
- Meals other than those specified in the Essential Trip Information
- Visa and passport fees
- Travel medical insurance
- Cancellation or trip interruption insurance
- Optional activities and all personal expenses
- Admissions to sites and activities not otherwise identified in the Trip Information
- Gratuities/tips to tour guides or drivers
- Any items not specified in the Inclusions list.
7. Cancellations by You and Refunds
To cancel your booking, you must submit your request to us in writing by email at [email protected]. Please follow-up with a phone call to discuss any cancellation fees. Cancellation fees will be applied per person according to the following schedule, based on the date we receive your written notification:
- 60 days or more prior to departure, we will retain a portion of the deposit equal to 10% of the total trip fee, and will return the remainder of your deposit;
- Between 31 and 60 days prior to departure, we will retain the entire deposit, and
- 30 days or less prior to departure, we will retain up to 100% paid by you in connection with the booking. In some instances we may be able to refund part of your booking where accommodations or travel tickets were partially refundable. The amount refunded will be determined on a case-by-case basis, in our sole discretion.
No refunds will be provided for any unused portion of a tour once the tour begins, including if you leave a tour for any reason or have to be removed from a tour. There are no exceptions to this cancellation and refund policy, including for reasons related to weather, terrorism, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. For this reason, we strongly encourage you to purchase trip cancellation and interruption insurance.
In some of our tours you will be required to show travel and medical insurance prior to being allowed to begin the tour.
8. Changes by You
If you change your tour dates or alter your itinerary after we confirm your tour, a change fee will be imposed. The type and scope of change dictates the amount of the change fee. Our outside suppliers, including hotels, often impose additional fees or penalties for changes and cancellations. These are included in the change fee and can be substantial.
If you wish to transfer from one trip to another, or transfer your booking to a third party you must notify us 60 days prior to the departure date.
A fee of $200 USD per person per change will apply (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 60 days prior to the proposed departure date the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current period.
Amendments to any other arrangements made in conjunction with your trip will incur a $130 USD administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators or airlines. No amendments are permitted to your booking within 10 days of departure.
9. Cancellations by Us
Our trips are guaranteed to depart once they have been confirmed, unless minimum group size specifically states otherwise. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary or if we perceive there to be a risk of harm, in our sole discretion. If we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control, refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel medical insurance excess, foreign exchange fluctuations or non-refundable flights.
If we cancel, which is rare, a check for a full refund will be issued to you less any airline ticket cancellation fees and nonrefundable deposits advanced to local suppliers. This refund will constitute full settlement of claims you may have arising out of our cancellation.
10. Changes of Itinerary by Us
We endeavour to operate all trips as described, however we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary.
The nature of these trips mean that changes to itinerary, as well as accommodations may be required and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
If we make a major change before departure then we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative tour offered.
We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries such as visas, vaccinations or non-refundable flights.
11. Price Adjustments
The quoted tour price is based on tariffs, fees, airfares, and costs in effect at the time you sign this agreement. We reserve the right to increase the quoted price after booking if inflation, costs of fuel, labor or materials, airfares, supplier costs, currency exchange rates, tariffs, government fees, and admission charges change.
We will be responsible for any price increases up to 3.5% of the trip cost. You agree to and will pay for any price increase beyond 3.5% of the total trip cost.
If any surcharge results in a price increase greater than 10% of the trip cost you will be eligible to cancel the trip within 10 days of notification and obtain a full refund.
12. Authority on tour
Our group trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader or interfere with the well-being or mobility of the group, or the group leader determines (in his or her sole discretion) that your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any other group members or any third party, or damage to property, or cause a delay or diversion to transportation, the group leader may direct you to leave the trip immediately, and we reserve the right to terminate your booking immediately with no right of refund. You and/or your party may be required to pay for loss and/or damage caused by your actions. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines. We cannot be held responsible for the actions or behaviour of other guests or individuals who have no connection with your booking arrangements or with us.
13. Acceptance of risk
You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.
14. Credit Card Authorization for Post-Booking Charges
You authorize 10Adventures Tours to charge your credit card number for any change fees, price increases, or supplemental payments that you incur post-booking. If you prefer a different payment method, you must notify us in writing at the time of booking.
15. No Refunds for Personal Expenses
You will not be reimbursed for any personal expenses such as airfare, hotel or other travel expenses due to changes in itineraries or tour cancellations.
10Adventures Tours acts only as an intermediary for the various independent suppliers that provide lodging, meals, transportation, sightseeing, activities or other goods and services connected with your tour (“Supplier” or “Suppliers”). You acknowledge that you are aware and clearly understand that these Suppliers are independent contractors, are not managed by 10Adventures Tours, and are not agents or employees of 10Adventures Tours. A Supplier’s services are subject to the Supplier’s own terms and conditions and the local laws and regulations of the relevant country. 10Adventures Tours will not provide any refund for a Supplier’s delay, cancellation, overbooking, or strike.
17. Force Majeure
10Adventures Tours will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of 10Adventures Tours, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances.
If 10Adventures Tours and/or any of its Suppliers are affected by Force Majeure, they shall be entitled to, and may in their sole discretion, vary or cancel any itinerary or arrangement in relation to the tour. Regarding civil unrest, once 10Adventures Tours has investigated the prevailing situation, as it deems fit, it shall remain in 10Adventures Tours’ sole and absolute discretion whether to proceed with the tour.
18. Travel Insurance
The tour price does not include travel insurance.
Travel medical insurance is mandatory for all travelers and should be taken out at the time of booking. Your travel medical insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover.
We strongly recommend that you purchase comprehensive travel insurance, covering trip interruption and cancellation, baggage, medical, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you.
You agree to assume all costs of medical care and transportation.
You may be required proof of coverage Travel Medical Insurance at the start of your trip. Failure to show travel insurance will result in you not being allowed on the trip.
19. Pre-Departure Documentation
It is important that you carefully read all trip-related documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect.
We cannot accept any liability if you do not notify us of any inaccuracies within 7 days of your receipt of those documents. This agreement, a waiver of liability and assumption of risk agreement and, if required, a medical statement or certification must be signed and submitted by you. If you fail to submit this and other necessary documentation prior to departure, we reserve the right to treat your booking as cancelled by you and impose the cancellation fees described in this agreement.
20. Passports and Visas
You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire tour.
Passports are required for all U.S. citizens traveling abroad and should be valid for at least 6 months after your date of return. We suggest you apply for or renew a passport early. Other required documents may include visas, permits, and vaccination certificates. You assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements. You are also solely responsible for any adverse consequences resulting from incomplete or defective documentation. While we may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, we are not responsible for any errors or omissions as to the information provided.
21. Health Requirements and Medical Care
Our tours are physically active, with varying levels of demands and fitness requirements depending on the specific itinerary. You represent that you do not have any physical or other conditions that would create a hazard for you or other Participants or affect other people’s enjoyment of the tour.
If you are over the age of 65 and have a pre-existing medical condition, you must share this information as part of the booking process. If you do not share this information, we reserve the right to prohibit you from departing on the tour and to charge a cancellation fee.
If you have a physical condition, dietary restrictions, or other conditions that will require special attention during the tour, you must inform us in writing when the booking is made. We may require a medical certificate if you have a special condition. We reserve the right in our sole discretion to accept, decline, or remove anyone from a tour (at departure or during the tour) who we judge to be incapable of meeting the tour’s physical demands.
10Adventures Tours assumes no responsibility for any medical care provided to you. You agree to assume all costs of medical care and related transportation that are provided to you during the tour.
22. Complaint Procedure:
If you have a complaint about your trip please inform your group leader or our local representative at the time in order that they can attempt to rectify the matter.
If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour.
23. Tour Start Date
It is your responsibility to be ready to embark on the tour as specified in the itinerary. 10Adventures Tours is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures.
24. Compliance with Local Laws and Tour Etiquette
You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During the tour, 10Adventures Tours or the local guide/supplier has the right in its sole discretion to remove anyone a) who it judges to be incapable of meeting the demands and requirements of participating in the tour activities; or b) who it determines to detract from others’ enjoyment of the tour.
25. Images Release
You agree that 10Adventures Tours may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our guides and/or other travelers of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the tour, you must inform us or your tour leader in writing at the start of the tour.
26. Limitation of Remedies
You agree that the sole remedy for any default by 10Adventures Tours arising under this agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, 10Adventures Tours shall not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if 10Adventures Tours has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.
If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision.
28. Successors and Assigns
This agreement shall inure to the benefit of and be binding upon 10Adventures Tours and the Participant and their respective heirs, legal personal representatives, successors and assigns.
29. Updating of Terms and Conditions
10Adventures Tours reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions. The latest terms and conditions can be found on the 10Adventures Tours website https://www.10a-tours.com/.
30. Applicable Law and Choice of Forum
Any dispute arising out of this agreement, including all tort claims – whether such dispute arises in contract or in tort or otherwise – shall be litigated and determined, if at all, only before a court of competent jurisdiction in the province of Alberta, Canada (and in no other).
This Agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.
